THIS DOCUMENT AND YOUR PURCHASE INVOICE MAKE UP THE PROTECTION PLAN WHICH LINKS THE PARTIES
Your original bill of sale and a copy of this warranty document must be provided in order receive service under this Plan.
PROTECTION PLAN FOR MATTRESS AND PILLOW PROTECTORS
The present document exposes all dispositions of the Protection Plan (Plan) entered in by both parties. Comerco Services Inc. (Comerco) agrees to guarantee this bedding protection product (mattress and pillow protector) to its original owner, according to the following terms and conditions:
1. COVERAGE:
For OPTIMUM model only, Comerco guarantees for a fifteen (15) year period following the date of purchase:
For PURELUX, INTEGRAL and FUSION models only, Comerco guarantees for a ten (10) year period following the date of purchase:
For all pillow protectors, Comerco guarantees for one (1) year following the date of purchase:
- will resist accidental stains from common household foods, beverages, medications and biological fluids of human or animal origin;
- will be free of defects in workmanship or material.
For the Mattress: When the mattress protector is purchased at the same time as a new mattress and installed on it, Comerco will provide coverage against accidental stains from common household foods, beverages, medications and biological fluids of human or animal origin.
2. ARE EXCLUDED FROM COMERCO’S RESPONSIBILITY:
2.1. Any damages other than damages caused by household foods, beverages, medications and biological fluids of human or animal origin.
2.2. Normal soiling from everyday use, including the accumulation of body perspiration. No fabric protector can prevent normal soiling and fabric protectors do not eliminate the need for routine care and regularly washing mattress and pillow protectors. Mattress and pillow protectors are designed and developed to resist staining and dry soiling; this Plan covers stain resistance only and not dry soiling. Soiling is defined as a gradual build-up of dirt, dust, body oils and perspiration, which cannot be attributed to single occurrences.
2.3. Damages caused by pets, other than biological fluid stains
2.4. Consequential damages, loss of use or delays resulting from the failure of the mattress protector or Comerco’s inability or delays to make necessary repairs.
2.5. Damages caused by improper washing or improper cleaning materials.
2.6. Damages caused by improper use or abuse.
2.7. Any damage to a box spring or bed base.
2.8. Odors.
2.9. Products used for commercial or rental use.
2.10. Mattresses which were not continuously protected by a Comerco mattress protector or that have not been purchased at the same time as a Comerco mattress protector.
2.11. Permanent stains on the mattress or the mattress and pillow protectors which have not been reported in the prescribed delay of fourteen (14) days. Permanent stains are defined as stains that persist even after cleaning the waterproof mattress protector or after professional cleaning by an authorized technician, in the case of a stained mattress.
2.12. Costs related to the removal and reinstallation of a product that is not easily accessible to the technician and the installation of a replacement mattress protector or mattress.
2.13. Repairs done by a service centre unauthorized by Comerco. In this case, the present Plan will become null and void.
3. IF A STAIN OCCURS ON THE MATRESS OR PILLOW PROTECTORS
Machine wash and dry the mattress or pillow protectors as quickly as possible, following the washing instructions. If the stain persists, contact our Customer Service Department at mattressprotectors@ comerco.com and provide the required information stated in section 5. If we cannot assist you in removing the stain, we will issue you a return authorization number and you will be required to return the damaged product to Comerco and receive a new equivalent mattress protector at no charge.
4. IF YOUR NEW MATTRESS IS AFFECTED BY AN INCIDENT COVERED, DUE TO A FAILURE OF THE MATTRESS PROTECTOR:
Contact our Customer Service Department at mattressprotectors@ comerco.com and provide the required information stated in section 5. If it is determined that the incident is covered, Comerco will have the mattress cleaned by an authorized technician. If the technician cannot remove the stain on the mattress, Comerco will replace the mattress with a mattress of equal quality, from the original selling retailer.
If the original selling retailer cannot perform the mattress replacement, Comerco’s responsibility is limited to the original purchase price, prorated, as determined by Comerco, on a ten (10) year period. If we ask you to return the product, it must have been washed following the washing instructions.
5. RESPONSIBILITIES OF THE CONSUMER:
You must provide the original bill of sale to benefit from the guarantee. You must contact Comerco within fourteen (14) days of the occurrence. Failure to provide proof of purchase or contact Comerco within fourteen (14) days will render the present Plan null and void. While contacting Comerco at mattressprotectors@comerco.com, you must provide:
- Your name address and phone number;
- The date of the incident;
- A description of the incident;
- A photo of the damage;
- A photo of your purchase invoice; and
- A photo of the product label.
The content label on the product must be attached at all times for identification purposes.
6. COMERCO’S OBLIGATIONS:
Under this Plan shall be limited to removing the stain or repairing or replacing or reimbursing the mattress or pillow protectors or the damaged mattress. The maximum liability of this Plan (the combined value of all repairs, credits, replacement costs and delivery) will not exceed the purchase price of the original mattress. Once a mattress has been replaced or a prorated indemnity has been paid to the owner, Comerco will have met all its obligations and the Plan will become null and void.
Please report all warranty claims within fourteen (14) days of the occurrence. CUSTOMER SERVICE: mattressprotectors@comerco.com
